Germany has deposited its ratification

As the German Federal Ministry of Justice just announced by a corresponding press release, Germany has ratified the Agreement on a Unified Patent Court today (February 17, 2023).

Consequently, and in accordance with latest news releases about another practier period for the CMS, the Sunrise Period for the UPC can, indeed, start as of March 1, 2023.

Finally, the UPC will open its doors on June 1, 2023, and will also bring the Unitary Patent into force as well in order to start off a new era of patent litigation in Europe.

Leythem Wall, president of EPLIT: “As expected, Germany has taken the final step for the UPC to become reality. This is indeed a new dawn in European patent law, practice and litigation, and one in which we can expect European patent attorneys, many of whom with full representation rights before the Court, to play a key role”.
